
1.Definitions
The Internet access service is
provided by Yemen International Telecommunications Company, “TeleYemen”,
under the service name of “Y.net”
The “Agreement” is the Order form together with these
Terms and Conditions, and any subsequent amendments, which become valid
by both the customer and TeleYemen.
The “customer” is the party, individual or corporate,
which enters into this Agreement with TeleYemen for the provision of Y.net
services.
“Tariffs” are those charges which are made by TeleYemen
for the provision and use of the Y.net service, and which are listed on
the current Y.net Tariff list obtainable on request from TeleYemen.
"Overdue Charges" are those charges which have not been
paid to TeleYemen by the payment date specified.
2- Terms & Conditions and Service Period
2.1. By signing this Agreement the Customer accepts the terms and
condition set out in the Agreement and the current Y.net Tariffs, and
TeleYemen agrees to provide Y.net services to the Customer according to
those terms and conditions and Tariffs.
2.2. TeleYemen reserves the right to amend the terms and condition
contained in this Agreement, and the Y.net Tariffs, at any time, and
Customer agrees to be bound by the terms and conditions so amended Notice
of the amendments will be sent by TeleYemen to the customer in writing at
his billing address.
2.3. The minimum period of subscription Y.net is one calendar month
commencing form the first day of the current month according to the
Gregorian calendar. Where the Agreement becomes valid between the first
and fifteenth day of the month, the subscription payable for that month
will be for the whole month. Where the Agreement becomes valid between the
sixteenth and the last day of the month, the subscription payable for that
month will be waived.
2.4. Subscription charges are
payable monthly in advance. Usage charges are payable monthly in arrears.
3- Termination of this Agreement
3.1.This Agreement remains in force until terminated
with this paragraph
3.2.This Agreement may be terminated at any time by the
customer on giving one month’s notice in writing to TeleYemen, and on
payment of all charges owed by the customer to TeleYemen. No refund will
be made of any subscription paid in advance.
3.3.This Agreement may be terminated by TeleYemen:
-
At any time, if
required to do by competent Authority
- At any time, if Customer is in breach of any of the terms and
condition of this Agreement.
- On one month’s notice in writing sent to the Customer at his
billing address.
3.4.TeleYemen may suspend the Y.net services or terminate this Agreement
if charges of services provided by TeleYemen to the same customer become overdue, and may suspend or terminate other service provided by TeleYemen
to the same Customer if charges for Y.net services become overdue.
3.5.When this Agreement is terminated, all charges which are customer to
TeleYemen become payable immediately
4- Service Provision and Access
4.1.Once the Agreement becomes valid, TeleYemen will provide the Customer
with a User Identification and Password
4.2 The customer is entirely responsible for providing himself with
suitable computer, modern and telephone line to access Y.Net, and
TeleYemen will not be required either to provide such items, or to ensure
their compatibility with the Y.net system. Telephone service is provided
by the Public Telecommunications Corporation of Yemen “PTC” according to
its published tariffs.
4.3. As access to the Y.net system is by dial-up connection over the
public switched telephone network “PSTN” operated by PTC, TeleYemen can
make no commitment in respect of the availability or quality of such
connections.
4.4. TeleYemen will state in its current Y.net general brochures,
obtainable on request form TeleYemen, the maximum data rate which the
Y.net system can accept over the dial-up access lines. Because of the
random nature of connections over the PSTN no assurance is given by
TeleYemen that any specific data rate can be achieved, or that any data
transmission can be achieved, over any access line.
5- Tariffs, Charges and Billing
5.1 The Y.net service will be provided under this Agreement according to
the tariffs published by TeleYemen and any amendments which may be from
time to time.
5.2 TeleYemen will provide the customer with a regular bill detailing the
charges which are due to TeleYemen for the Y.net services provided to the
customer. The customer will pay these charges to TeleYemen by the payment
date printed on the bill. If the payment becomes overdue, TeleYemen may
suspend to terminate service as set out in paragraph 3 of this agreement.
5.3. The Customer is responsible for the payment of all charges which are
incurred by use of the User Identification supplied by TeleYemen. TeleYemen recommends the customer to make such care of the User
Identification and Password that no unauthorised use may be made of them.
5.4. TeleYemen will make its best endeavours to deliver the Bills to the
address nominated by the Customer in the form. However, should the
customer fail to receive the bill within 10 days of the regular date of
issue, the customer should contact a TeleYemen office to obtain a copy of
the bill in order make payment of all charges by the payment date.
6- Customer and TeleYemen Responsibilities
6.1.The Customer shall not:
6.1.1. Use the Y.net service for any illegal purposes, nor for sending
any massage which is offensive on moral, religious, communal, or
political grounds, or is abusive, of an indecent, obscene,
or menacing character.
6.1.2. Use the Y.net service for sending message without reasonable
cause, or for causing any threat, harassment, annoyance, inconvenience
or needless anxiety to any person whomsoever.
6.1.3. Use the Y.net service to evade or contravene the laws of any
State, or to infringe the copyright, or any other intellectual property
rights, to the information or resources available through Y.net
6.1.4. Use the Y.net service to again access, or attempt to again access,
to any information, resource, or computer system to which access is
restricted, without holding valid authority for such access.
6.1.5. Use the Y.net service to disseminate to any person whatever any
information which is subject to control or restriction by any computer
Authority for such access.
6.1.6. Trade on, resell, hire, assign, transfer access, or in any other
way dispose of the Y.net service without prior approval form TeleYemen.
6.2 The Customer Shall:
6.2.1 Indemnify and hold harmless TeleYemen against any liability
whatsoever resulting from any breach of these terms and condition, or
any use of the Y.net services contrary to these terms and conditions
6.2.2. Comply with all directors issued by TeleYemen regarding the
access, use, management, storage and transmission of information through
Y.net
6.3. TeleYemen shall
6.3.1. Make all reasonable efforts to ensure that the Y.net service is
available 24 hours per day, or during any such less time as may be
advised to the customer, but TeleYemen shall not be liable in any manner
for any failure, or any consequences resulting form failure, to provide
the Y.net service, for any reason whatever.
6.3.2. Make all reasonable efforts to ensure that when, form time to
time, it is necessary to deny access to Y.net in order to undertake work
for the essential maintenance, repair and development of Y.net
services, such denial of access the causes the least inconvenience to
all Customer.
6.3.3. Report to the competent authorities, any use or attempted use of
the Y.net service which contravenes any applicable Law of the Republic
of Yemen.
7- Limitations
7.1. TeleYemen reserves the right to manage and control the access to
computer system and data stored in the Y.net system in any manner deemed
appropriate by TeleYemen
7.2. While all reasonable efforts will be made by TeleYemen to ensure that
Y.net services are provided to the Customer according to this Agreement,
TeleYemen disclaims all liability whatsoever for any loss or corruption of
data however caused, and for any other loss, damage or liability of the
Customer in consequence of, or in connection with, any use of the Y.net
service.
7.3. Access to applications which transmit or receive live video or audio,
or audio, or make similar demands on the capacity of the network,
constitutes an unreasonable usage which may affect the performance of the
network, and is not permitted.
8- Laws and Interpretations
8.1.This Agreement is subject to, and is applied in accordance with, the
Laws of the Republic of Yemen
8.2.The Arabic text of this Agreement is the definitive Agreement. The
English text is for reference and guidance only.
Yemen
International Telecommunications Company “TeleYemen” provides the
service of Homepage Hosting & Domain Name Registration in Teleyemen
Web Pages Server. This
agreement becomes valid when the customer sign the Web Page Hosting Order
Form.

1.1 The “Customer” is the party, individual or entity, which
enters into this Agreement with TeleYemen.

“Tariffs” are those charges which are made by TeleYemen
Homepage Hosting & Domain Name Registration.
1-3 “Overdue Charges” are those charges which have not been paid
by the customer in time.
2.
Terms and Conditions:
2.1 By signing the
Application Form for Homepage Hosting & Domain Name Registration the
customer accepts the terms and conditions set out in the Agreement, and
the current tariff relating to inputting home pages.
TeleYemen agrees to provide the service according to those terms
and conditions and tariffs.
2.2
The monthly subscription fees are payable at the beginning of
each month.
3.
Termination of this agreement
3.1
This Agreement shall remain in force until it is terminated in
accordance with this paragraph.
3.2
The customer may terminate this Agreement at any time
by giving a notice in writing to Teleyemen one moth prior to the
date of termination provided he pays all charges due to Teleyemen.
No refund will be made of any charges or subscriptions paid in
advance.
3.3
TeleYemen may terminate the agreement in any of the following
cases:-
3.3.1
At any time, if required to do so by the competent authorities.
3.3.2
At any time, if the Customer is in breach of any of the terms and
conditions of this Agreement.
3.3.3
By serving the customer one month’s notice in writing to be
sent to him at his billing address.
4.
Customer Responsibilities
4.1
The customer hosting his
home pages in the Y.net homepage server shall not:
4.1.1
Have any pages that contain obscene pictures or are offensive on
moral grounds.
4.1.2
Have any pages including data that are inconsistent with the
provisions of the Holy Qoran, the Prophet Mohamed’s Traditions and the
Islamic jurisdiction.
4.1.3
Have any home pages that are offensive on moral, religion,
communal or political grounds.
4.1.4
Have any home pages that may cause disturbance of security,
National Unity, instability, call for or encourage such illegal acts in the country.
4.1.5
Have any data that are offensive to Yemen, its history, culture
and relationship with any of the
world countries.
4.1.6
Have any pages that contains defamatory data against any party,
entity in Yemen or abroad.
5. Customer Liabilities
5.1 The customer must guarantee to compensate Teleyemen and keep it
indemnified and harmless against any liability whatsoever resulting from
any breach of these terms and conditions.
6.
TeleYemen Responsibility
TeleYemen
shall:
6.1
Input the customer home pages into the Internet Server according
to the name and type of the site selected by the customer.
6.2
Make the customer home pages available to all those who wish to
have access to 24 hours per day.
6.3
Grant the customer FTP Account to enable him to input and amend
the contents of his home pages.
6.4
Report to the competent authority any use or attempted use of the
service in a manner that contravenes with the laws and the constitution
of the Republic of Yemen.
7. Limitations
7.1 Teleyemen reserves the right to monitor the customer home pages in
any manner that deems fit.
7.2 Teleyemen disclaims all liability whatsoever for any loss or
corruption of data however caused.
8.
Laws and Interpretations
8.1
This Agreement is subject to, and is applied in accordance with the Laws
of the Republic of Yemen.
8.2
The Arabic text of this Agreement is the definite Agreement. The
English text is for guidance only.
